Welcome to Haul Yeah Equipment Rental (“Haul Yeah,” “we,” “us,” “our”). These Terms & Conditions (“Terms”) govern all equipment rentals, deliveries, and related services provided by Haul Yeah. By reserving, renting, taking possession of, or using any equipment, the customer (“Customer,” “you,” “your”) agrees to these Terms.

🏗️ 1. Definitions


  1. “Equipment” means any rented item(s), attachments, accessories, tools, trailers, and/or related components provided by Haul Yeah.

  2. “Rental Period” means the time from when Equipment leaves our control (or is delivered) until it is returned to our control and accepted by us. Many rental companies treat risk as remaining with the customer until the company takes possession again. 

  3. “Delivery” includes drop-off, placement, and pickup if scheduled.

  4. “Order/Reservation” includes any request submitted via website form, phone, text, email, or internal booking system.



🧾 2. Reservations, Requests & Approval


  1. Website requests are reservation requests and are not guaranteed until confirmed by Haul Yeah.

  2. We may require additional information to confirm: job site address, dates, access conditions, and intended use.

  3. We may decline or cancel any reservation in our discretion (e.g., unsafe site conditions, lack of availability, payment issues).



💳 3. Rates, Minimums, Fees & Payment


  1. Minimum Rental: Rentals may be subject to a 4-hour minimum (or as displayed on the website/quote).

  2. Rates: Hourly/daily/weekly/monthly rates may change without notice and are not final until confirmed in writing.

  3. Payment Due: Unless otherwise agreed in writing, payment is due before release/delivery of Equipment.

  4. Additional Fees May Include: delivery/pickup, fuel, cleaning, damage repairs, missing parts, late returns, tolls, after-hours service, administrative/environmental fees (if applicable), and taxes. Many rental agreements explicitly allow these add-on charges. 

  5. Taxes: You are responsible for applicable sales tax and other required charges.



🚚 4. Delivery & Pickup (Job Site Logistics)


  1. Access Requirements: Customer must ensure safe access for delivery vehicles (clearances, gate access, stable ground, and adequate space).

  2. Placement: Customer is responsible for directing placement at the job site and confirming that the placement location is safe and legal.

  3. Pickup Responsibility: If Haul Yeah agrees to pick up Equipment, Customer remains responsible for loss/damage until Haul Yeah takes possession of the Equipment. 

  4. Missed Pickup / Inaccessible Equipment: If Equipment cannot be accessed for pickup at the scheduled time (blocked in, locked behind gates, unsafe conditions), additional charges may apply and the Rental Period continues.



🧰 5. Customer Responsibilities (Use, Safety, Operators)


  1. Qualified Operators Only: Customer must restrict operation to trained/qualified personnel and comply with all manuals, warnings, and safety requirements. Many rental terms require operation only by qualified personnel. 

  2. Legal Compliance: Customer is responsible for all permits, utility locates (Call 811), right-of-way rules, DOT compliance (if towing), and compliance with all laws/regulations.

  3. Prohibited Use: Equipment may not be used:

    • for illegal purposes or reckless operation

    • outside rated capacities or manufacturer guidelines

    • in hazardous conditions without required protections

    • for subleasing or “renting out” to third parties without written approval

  4. Security: Customer must secure Equipment against theft/vandalism (remove keys if provided, lock/secure site, etc.).



🛠️ 6. Maintenance, Breakdowns & Downtime


  1. Normal Wear: Normal wear is expected; abuse is not.

  2. No Repairs by Customer: Do not repair or modify Equipment without written permission.

  3. Breakdowns: Notify Haul Yeah immediately if Equipment malfunctions. Continued operation after a problem is discovered may be treated as misuse.

  4. Downtime: Credit for downtime (if any) is at Haul Yeah’s discretion and generally applies only when equipment failure is not caused by Customer misuse and is promptly reported.



⛽ 7. Fuel, Cleaning & Return Condition


  1. Fuel: Equipment must be returned with the same fuel level as delivered (or customer will be charged refueling).

  2. Cleaning: Excessive mud/concrete/paint/asphalt/adhesive residue or debris may result in cleaning fees.

  3. Return Condition: Equipment must be returned with all included accessories, attachments, keys, and safety components.



⚠️ 8. Damage, Loss, Theft & Responsibility


  1. Customer Responsible: Customer is responsible for all loss, theft, or damage to Equipment from the time it leaves Haul Yeah’s control (or is delivered) until it is returned and accepted by Haul Yeah—regardless of fault, including damage occurring outside the quoted rental period if the Equipment is not returned. This approach is common in rental terms. 

  2. Incident Reporting: Customer must immediately report any theft, vandalism, accident, seizure/impound, or damage, and cooperate with police reports/insurance claims.

  3. Recovery: If stolen Equipment is recovered, Customer must promptly notify Haul Yeah and assist with return/claims. Major rental terms often require customer cooperation and assignment of claims/proceeds to the rental company. 

  4. Costs: Customer is responsible for repair/replacement costs, labor, transport, parts, diminished value where allowed, and loss of rental income during repair (where permitted).



🛡️ 9. Optional Damage Waiver / Rental Protection (If Offered)


  1. If Haul Yeah offers a Damage Waiver / Rental Protection Plan, it is not insurance and does not cover every situation. Large rental providers describe similar programs as a waiver that can limit responsibility for certain accidental damage/theft, while excluding many causes and requiring customers to check their own insurance. 

  2. Exclusions typically include (example list—adjust to your policy): misuse, overloading, negligence, water submersion, unauthorized transport, tire/track damage, missing parts, theft due to failure to secure, and damage from prohibited uses.

  3. Any waiver terms will be provided at checkout/confirmation and are incorporated into these Terms.



🧾 10. Insurance Requirements


  1. Customer may be required to provide proof of insurance (general liability and/or inland marine/equipment coverage) upon request.

  2. Customer is responsible for deductibles and any gaps in coverage.

  3. If Customer fails to maintain required coverage, Haul Yeah may cancel the rental or require alternative protections.



🧱 11. Indemnification (You Protect Us)


Customer agrees to defend, indemnify, and hold harmless Haul Yeah and its owners/employees from claims, damages, losses, fines, and expenses (including attorney fees) arising out of: (a) Customer’s use/operation/possession of Equipment, (b) injuries or property damage at the job site, (c) Customer’s breach of these Terms, or (d) violations of law.



🚫 12. Limitation of Liability


To the fullest extent allowed by law:

  1. Haul Yeah is not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, project delays, or business interruption).

  2. Haul Yeah’s total liability for any claim is limited to the amounts paid for the rental related to the claim (or the minimum allowed by law, whichever is greater).

  3. Customer acknowledges equipment use involves inherent risks and assumes those risks.



⏰ 13. Late Returns, Extensions & Abandonment


  1. Late Returns: If Equipment is not returned by the agreed time, additional rental charges apply.

  2. Extensions: Extensions must be approved by Haul Yeah before the return time; availability is not guaranteed.

  3. Abandonment: Equipment left unsecured or abandoned may be recovered at Customer’s expense and may incur additional fees.



❌ 14. Cancellations & No-Shows


  1. Cancellations: Cancellation policies (including any fees) may vary by Equipment type, lead time, and delivery scheduling.

  2. No-Shows / Refused Deliveries: If delivery is attempted and refused or job site is inaccessible/unsafe, Customer may be charged delivery and/or minimum rental fees.



🧾 15. Collections, Fees & Authorization


  1. Customer authorizes Haul Yeah to charge the payment method on file for rental charges and additional charges incurred under these Terms (fuel, cleaning, damage, late returns, etc.).

  2. Past due amounts may incur interest/late fees where permitted and Customer may be responsible for collection costs (including reasonable attorney fees).



📝 16. Privacy & Communications


  1. By submitting a form or booking, Customer consents to be contacted via phone, text, and email regarding the rental/reservation.

  2. Customer is responsible for providing accurate contact information.



🌪️ 17. Force Majeure


Haul Yeah is not responsible for delays or failure to perform due to events beyond our control (weather, disasters, road closures, mechanical failures, supply disruptions, etc.). In such events, we may reschedule, substitute equipment (with approval), or cancel.



⚖️ 18. Governing Law & Disputes


  1. These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules.

  2. Venue for disputes shall be in the county where Haul Yeah is principally located, unless otherwise required by law.

  3. (Optional) You may add mediation/arbitration language here if you want a tighter dispute process.



🔁 19. Entire Agreement & Updates


  1. These Terms, together with the reservation confirmation/quote and any waiver addendum, constitute the entire agreement.

  2. If any provision is found unenforceable, the rest remains in effect.

  3. Haul Yeah may update these Terms from time to time; the version in effect at the time of reservation/rental controls.



✅ 20. Acceptance


By reserving, receiving, or using any Equipment from Haul Yeah, Customer acknowledges they have read, understand, and agree to these Terms & Conditions.
